Title Curative

Title Curative

Title opinions and due diligence reports turn up requirements. Optima’s curative team of attorneys and experienced landmen works each requirement to a documented resolution, on schedule, so wells can be permitted, owners can be paid and deals can close.

What we do

  • Requirement tracking. Log every drilling or division order title opinion requirement, assign it and work it to a documented resolution.

  • Curative instruments. Draft and obtain affidavits of heirship, affidavits of use and possession, stipulations of interest, ratifications, corrections and releases.

  • NPRI ratifications. Obtain ratifications from non-participating royalty owners so pooled and unitized wells pay correctly.

  • Heirship and estate issues. Track down heirs and estate representatives and gather the records needed to establish ownership.

  • Owner contact and relations. Locate mineral and royalty owners, explain what is needed and why, and follow through until documents are signed and recorded.

  • Revenue deck support. Help set up and correct revenue decks once ownership is cleared.

  • Transaction defects. Cure defects identified in due diligence, before or after closing.

What you receive

  • A curative tracking sheet with the status of every requirement

  • Signed and recorded instruments with recording information

  • Responses to each requirement, ready for the examining attorney

  • Updated ownership for division orders and the revenue deck

How a project runs

  1. Intake. We review the title opinion or defect report and sort the requirements by priority and effort.

  2. Plan the cure. We choose the cure for each requirement: a new instrument, an affidavit, a ratification or a waiver request to the examining attorney.

  3. Work the requirements. We draft instruments, contact owners, obtain signatures and record documents.

  4. Close out. Each requirement is reported as satisfied, with supporting documents, so the examiner can clear it.
